Non‑Discrimination Policy
Title VI of the Civil Rights Act of 1964 prohibits discrimination on the grounds of race, color, and national origin in programs and activities that receive federal financial assistance.
Empire Diversified Energy, Inc. complies with Title VI and related federal statutes, regulations, and Executive Orders. We administer programs, services, and activities without regard to race, color, national origin, sex, age, or disability, including income level and persons with Limited English Proficiency (LEP), consistent with 49 CFR Parts 21, 25, and 27 and the DOT Standard Title VI Assurances and Non‑Discrimination Provisions.
This policy is posted on our website and labor law bulletin boards and is distributed to employees annually. Upon request, it is available in alternative formats and languages.
Non-Discrimination Policy Statement
Title VI of the Civil Rights Act of 1964 prohibits discrimination on the grounds of race, color and national origin in programs and activities that receive federal financial assistance.
Empire Diversified Energy, Inc. (Empire) is committed to compliance with the non-discrimination requirements of Title VI of the Civil Rights Act of 1964 and all related federal statutes, regulations and Executive Orders. In accordance with these requirements, Empire commits to administer its programs, services and program activities without regard to race, color, national origin, sex, age, or disability, including income-level and persons who are Limited English Proficient (LEP) as required by the nondiscrimination provisions of 49 CFR Part 21, 49 CFR Part 25, 49 CFR Part 27, and the DOT Standard Title VI Assurances and Non-Discrimination Provisions. Empire will take reasonable steps to provide access to its services to people with disabilities and those with Limited English Proficiency (LEP).
Empire will make every effort to ensure that all its recipients of federal funds comply with the non-discrimination provisions of its Title VI/ADA Program. Empire further certifies that all its programs will be administered in accordance with these provisions.
Any person who believes that he/she individually or as a group has been subjected to discrimination prohibited by this policy may file a complaint within one hundred and eighty (180) days of the alleged discriminatory conduct. Requests for additional information must be sent to (or complaints must be filed with) Compliance Team, Empire Diversified Energy, Inc., 1400 Main Street, 2nd Floor, Follansbee, WV 26037, or via email at compliance@empirede.com.
Empire employees and affected personnel are directed to coordinate with Holly Trejo or Compliance Team to ensure the effective implementation of DOT Title VI and ADA requirements.
This policy will be distributed annually to all employees and posted on Empire’s website (https://empirediversifiedenergy.com/) and labor law bulletin boards. Upon request, this policy will be made available in a language other than English and in alternative formats. Empire’s compliance with the nondiscrimination requirements of the Title VI program and the ADA will be monitored by Holly Trejo.

Public Notice of Non‑Discrimination Rights
Empire Diversified Energy, Inc. gives public notice of our policy to uphold and assure full compliance with the non‑discrimination requirements of Title VI of the Civil Rights Act of 1964 and related authorities. No person in the United States shall, on the grounds of race, color, national origin, sex, age, disability, income level, or LEP, be excluded from participation in, denied the benefits of, or otherwise subjected to discrimination under any program or activity receiving Federal financial assistance.
Any person who believes they have been subjected to discrimination may file a formal complaint within 180 days of the alleged occurrence. You may also file a complaint directly with the U.S. Maritime Administration Office of Civil Rights (civilrights.marad@dot.gov).
Public Notice of Non-Discrimination Rights
Empire Diversified Energy, Inc. (Empire) gives public notice of its policy to uphold and assure full compliance with the non-discrimination requirements of Title VI of the Civil Rights Act of 1964 and related nondiscrimination authorities. Title VI and related nondiscrimination authorities stipulate that no person in the United States of America shall on the grounds of race, color, national origin, sex, age, disability, income level or Limited English Proficiency be excluded from the participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity receiving Federal financial assistance.

Any person who believes they have, individually or as a member of any specific class of persons, been subjected to discrimination based on race, color, national origin, sex, age, disability, income level or Limited English Proficiency has the right to file a formal complaint. Title VI & ADA Discrimination Complaint Procedures
We have established procedures for the review and resolution of allegations of discrimination filed under Title VI and the Americans with Disabilities Act (ADA). A complaint must be filed within 180 calendar days of the alleged occurrence or when it became known to the complainant. Complaints may be submitted electronically to compliance@empirede.com or by mail.
- We acknowledge receipt of the complaint in writing.
- We notify the accused party(ies) within 30 days of acceptance of the complaint.
- An investigation is conducted and a resolution is sought within 90 business days (barring extenuating circumstances).
- The complainant may appeal in writing to the Empire Executive Team within 10 business days of the resolution.
- Appeals are decided within 30 business days of filing; decisions are communicated in writing.

Who may file & when
Any individual or group who believes they were subjected to discrimination based on race, color, national origin (including Limited English Proficiency), or disability may file a complaint. A formal complaint must be filed within 180 calendar days of the alleged act, or when it became known.

Use the official form & include
- Completed and signed Title VI & ADA Discrimination Complaint Form.
- Your full name and mailing address.
- Date(s) of the alleged discrimination.
- Name(s), title(s), and work address(es) of the accused (if known).
- Detailed description of the alleged discrimination (issues and circumstances).
- Identify the basis: race, color, national origin (LEP), and/or disability.
- Names and contact information for any witnesses.
Assistance: If you cannot provide a written complaint, assistance will be provided; all complaints must be signed by the complainant or authorized legal designee.
Acceptance & dismissal
To be accepted, complaints must be filed within 180 days, meet the filing requirements above, and allege discrimination based on the protected bases noted. A complaint may be dismissed if the complainant withdraws it, fails to respond to information requests by the stated date, or if the filing is untimely.
Investigation process
- Acknowledgement: We will acknowledge receipt in writing.
- Notice to accused: The accused party(ies) will be notified within 30 days after the complaint is accepted, and may be advised of their right to representation.
- Fact-finding & resolution: Barring extenuating circumstances, an investigation will be conducted and, if possible, a resolution provided within 90 business days of receipt. All parties will be notified in writing whether a violation of Title VI occurred and the complainant will be informed of appeal rights.
Appeals
If you wish to appeal, submit a written appeal to the Empire executive team within 10 business days of receiving the resolution. A written appeal decision will be issued within 30 business days of the appeal filing.
Records & confidentiality
All complaint records are maintained and periodically reviewed to detect patterns. Records are retained on a strictly confidential basis except where disclosure is required by law.
